Dear ICC Chair Jennifer Lynch:

First, we would like to express our sincere gratitude for your reply dated 9/25 to the e-mail sent earlier by the NGOs of South Korea and for your attention to our concern about the National Human Rights Commission of Korea (NHRCK). To raise and to protect the NHRCK, whose independence is under threat, human rights activist organizations in South Korea have formed and are actively involved in a coalition called the Action to Place the National Human Rights Commission in Its Place in Korea.

As you well know, the NHRCK faces a crisis at this moment. Already earlier this year, the ICC sent an open letter to the South Korean government stressing the procedures through which the chair and commissioners of national human rights institutions are appointed. However, instead of reforming and improving its NHRCK chair and commissioner appointment process, the South Korean government went on to appoint as the new chair of the Commission Mr. Hyun Byung-Chul, a figure who is utterly inexperienced in and unrelated to human rights. Furthermore, Chair Hyun even claimed at a session of the National Assembly, an official and open occasion, that the "NHRCK [was and should be] under the executive branch,"thus denying the independence of the Commission and violating the Paris Principles. When opposition became strong, on October 15, Chair Hyun explained himself, saying that he "[had] a firm belief in the independence of the NHRCK" and would "strive to secure its actual independence."In the view of us South Korean human rights activist organizations, however, Chair Hyun still lacks an understanding of the concept ofindependence itself. Moreover, not only Chair Hyun but also even some of the commissioners of the NHRCK are ignorant of the concept of independence and show little effort to protect it.

Nor are Chair Hyun¡¯s problems limited to those enumerated above. In fact, he is known to refuse the minimum of democratic procedures and communication, as is clear from his arbitrary and one-sided appointment of some of the commissioners within the NHRCK who are linked to the very independence of the Commission. In addition, Chair Hyun has continued to exhibit autocratic behavior such as his forced nomination of Mr. Kim Ockshin as the NHRCK¡¯s Secretary-General, whose appointment materialized on 10/6, even though the majority of the Plenary Committee had opposed Mr. Kim as the candidate for the post earlier.

As the examples above show, Chair Hyun is damaging the independence of the NHRCK both internally and externally and losing his credibility as its chair even though, considering his very position, he must strive even further to guarantee and to protect the Commission¡¯s independence instead. It is our understanding that, consequently, the Asian NGOs Network on National Human Rights Institutions (ANNI) and the Asian Human Rights Commission (AHRC), too, have sent you letters requesting the ICC to dispatch a fact-finding mission to South Korea. We fully agree with the contents of these organizations¡¯ letters and earnestly beseech you to take the following measure:

¡Ü We urgently request that the ICC promptly dispatch a fact-finding mission to investigate the South Korean government¡¯s measures that are damaging the independence of the NHRCK.

We deeply appreciate your concern and hope for your continued support. We also pledge to do our utmost to protect and promote human rights in South Korea despite and because of the threat that the NHRCK faces.
