1. 귀 언론사에 연대의 인사를 올립니다.
2. 「국가인권위 제자리 찾기 공동행동」은 전국 87개 단체로 구성되어, 이명박 정권에 들어 독립성에 위협을 받고 있는 국가인권위가 제대로 된 역할을 할 수 있도록 활동하는 연대체입니다.
3. 지난 10월 15일 현병철 국가인권위원장(이하 현위원장)은 “국가인권위원회 독립성 등에 관한 인권위원장 입장”을 통해 지난 9월 18일 국회 운영위원회에서의 국가인권위 독립성 부정 발언에 대한 해명을 하였습니다. 그 내용인즉슨, ‘독립성과 조직축소에 대해 그 동안 위원회에서 발표한 기본 입장에 대해 이견이 없’고, ‘위원회의 실질적인 독립성을 확보하기 위해 노력할 것임을 밝힌다’고 하였습니다. 그러나 현위원장의 해명을 요구한 지난 10월 12일 전원위원회를 공동행동 활동가들이 방청을 한 결과, 현위원장은 여전히 ‘독립성’에 대해 제대로 된 이해가 부족하고, ‘위원장’으로서 자신의 발언과 행동들에 대해 아무런 사과 한 마디도 없이 전원위원회의 요구를 그대로 문서에 옮겨 적은 듯한 해명은 그저 지금의 상황을 모면하기 위한 ‘면피용 해명’이라고 판단됩니다.
4. 한편 지난 10월 12일 전원위원회에서 보여준 몇몇 위원들의 태도 또한 큰 문제가 있습니다. 인권위원으로서 국가인권위에 대해 최소한으로 가져야 할 관심이 부재하고, 이 날 공개회의가 개인의 프라이버시를 침해하는 것이라는 등 현위원장의 독립성 부정 발언을 개인의 문제로 치부해버리려는 듯한 소수 위원들의 태도는 심각한 상황이었습니다. 이처럼 현위원장 뿐만 아니라 몇몇 위원들조차도 인권과 국가인권위에 대해 무지하고, 무책임한 태도는 벼랑 끝으로 내몰리고 있는 국가인권위의가 앞으로도 본연의 임무를 수행하는데 있어 내부적인 큰 걸림돌이 되지는 않을 런지 깊이 우려스럽습니다.
5. 이에 공동행동은 10월 22일(목) 국가인권기구 국제조정위원회(ICC) 제니퍼 린치에 한국 국가인권위원회 독립성 훼손 관련 진상조사단 파견을 요청하는 서한을 발송하였습니다. 이번 서한은 아메리카 지역, 아시아-태평양 지역, 유럽지역, 아프리카 지역 등 4개의 지역 포럼 의장과 유엔인권고등판무관실의 국가인권기구부서장에게도 함께 전달되었습니다. ICC 승인소위원회는 위 4개 지역의 의장국으로 구성됩니다. 참고로 ICC 사무국 회의가 올해 11월 1일~2일에 모로코에서 열리며, 차기 승인소위원회는 11월 16일~19일과 2010년 3월 스위스 제네바에서 열릴 예정입니다.

먼저, 저희 한국의 인권단체들이 보낸 메일에 지난 9월 25일자로 답변해주시며 한국 국가인권위원회에 대한 우려에 주목해주신 점 진심으로 감사드립니다. 한국의 인권단체들은 독립성을 위협받고 있는 국가인권위를 바로 세우기 위해 ‘국가인권위 제자리 찾기 공동행동’(Action to Place the National Human Rights Commission in its place in Korea)이라는 연대단체를 꾸려 활동 중입니다.
의장님께서도 아시다시피, 현재 한국 국가인권위원회는 위기에 처해 있습니다. ICC에서는 이미 올해 초 인권위원들의 임명 절차의 중요성을 강조하는 공개서한을 한국 정부에 보냈습니다. 그럼에도 불구하고 한국정부는 인권위원 임명절차 제도를 개선하기는커녕 인권과 전혀 관련이 없는 인물인 현병철 교수를 인권위원장으로 임명하였습니다. 또 현병철 위원장은 국회라는 공식성상에서 “국가인권위는 행정부 소속이다”라며 국가인권위의 독립성을 부정하며 ‘파리원칙’에 어긋나는 발언을 하였습니다. 이에 반발이 거세지자 현위원장은 10월 15일 “국가인권위의 독립성에 대한 신념은 확고히 가지고 있다”며 “실질적인 독립성을 확보하기 위해 노력할 것”임을 밝히며 해명하였습니다. 그러나 저희 인권단체들이 보기에 현위원장은 여전히 ‘독립성’이라는 개념 자체에 대한 이해가 부족해보입니다. 비단 현위원장 뿐만 아니라 소수의 인권위원들 또한 ‘독립성’에 대해 무지하고, 그것을 지켜나가기 위한 노력이 없어 보입니다.
현위원장의 문제는 이뿐만이 아닙니다. 현위원장은 국가인권위의 독립성 문제와 연결된 내부 직원 인사에 대해서도 다른 위원들과의 상의 없이 독단적으로 단행을 하는 등 최소한의 민주적인 절차와 소통을 하지 않는 것으로 알려져 있습니다. 또한 지난 10월 6일 임명된 김옥신 사무총장에 대해서도 전원위원회에서 제청 반대의 의견이 더 많았음에도 불구하고 현위원장이 청와대에 임명 제청을 강행하는 등 독단적인 행동을 계속하고 있습니다.
이처럼 현위원장은 ‘위원장’으로서 국가인권위의 독립성을 위해 더욱 노력해야 함에도 불구하고, 오히려 내부적으로나 외부적으로나 국가인권위의 독립성을 훼손하고 있고, 또 위원장으로서 신뢰를 잃어가고 있습니다. 이에 Asian NGOs on National Human Rights Institutions(ANNI)와 Asian Human Rights Commission(AHRC)에서도 ICC 제니퍼 린치 의장님께 한국에 진상조사단 파견을 요구하는 서한을 보낸 것으로 알고 있습니다. 저희 단체들은 이 서한내용에 동의하며, ICC 제니퍼 린치 의장님께 다음과 같이 요청합니다.
● ICC에서 현재 한국 국가인권위원회의 독립성을 훼손하고 있는 일들에 대한 사실 조사를 위한 진상조사단 파견을 요구합니다.
서한을 읽어주셔서 진심으로 감사드리며, 저희 단체들은 위협받고 있는 국가인권위의 한국의 인권상황에 적극적으로 인권옹호활동을 펼치며 노력을 다할 것입니다.

Dear ICC Chair Jennifer Lynch:
First, we would like to express our sincere gratitude for your reply dated 9/25 to the e-mail sent earlier by the NGOs of South Korea and for your attention to our concern about the National Human Rights Commission of Korea (NHRCK). To raise and to protect the NHRCK, whose independence is under threat, human rights activist organizations in South Korea have formed and are actively involved in a coalition called the Action to Place the National Human Rights Commission in Its Place in Korea.
As you well know, the NHRCK faces a crisis at this moment. Already earlier this year, the ICC sent an open letter to the South Korean government stressing the procedures through which the chair and commissioners of national human rights institutions are appointed. However, instead of reforming and improving its NHRCK chair and commissioner appointment process, the South Korean government went on to appoint as the new chair of the Commission Mr. Hyun Byung-Chul, a figure who is utterly inexperienced in and unrelated to human rights. Furthermore, Chair Hyun even claimed at a session of the National Assembly, an official and open occasion, that the "NHRCK [was and should be] under the executive branch,"thus denying the independence of the Commission and violating the Paris Principles. When opposition became strong, on October 15, Chair Hyun explained himself, saying that he "[had] a firm belief in the independence of the NHRCK" and would "strive to secure its actual independence."In the view of us South Korean human rights activist organizations, however, Chair Hyun still lacks an understanding of the concept ofindependence itself. Moreover, not only Chair Hyun but also even some of the commissioners of the NHRCK are ignorant of the concept of independence and show little effort to protect it.
Nor are Chair Hyun’s problems limited to those enumerated above. In fact, he is known to refuse the minimum of democratic procedures and communication, as is clear from his arbitrary and one-sided appointment of some of the commissioners within the NHRCK who are linked to the very independence of the Commission. In addition, Chair Hyun has continued to exhibit autocratic behavior such as his forced nomination of Mr. Kim Ockshin as the NHRCK’s Secretary-General, whose appointment materialized on 10/6, even though the majority of the Plenary Committee had opposed Mr. Kim as the candidate for the post earlier.
As the examples above show, Chair Hyun is damaging the independence of the NHRCK both internally and externally and losing his credibility as its chair even though, considering his very position, he must strive even further to guarantee and to protect the Commission’s independence instead. It is our understanding that, consequently, the Asian NGOs Network on National Human Rights Institutions (ANNI) and the Asian Human Rights Commission (AHRC), too, have sent you letters requesting the ICC to dispatch a fact-finding mission to South Korea. We fully agree with the contents of these organizations’ letters and earnestly beseech you to take the following measure:
● We urgently request that the ICC promptly dispatch a fact-finding mission to investigate the South Korean government’s measures that are damaging the independence of the NHRCK.
We deeply appreciate your concern and hope for your continued support. We also pledge to do our utmost to protect and promote human rights in South Korea despite and because of the threat that the NHRCK faces.
