Annex: Recommendations from the ICC Sub-Committee on Accreditation during the Accreditation-Review of the NHRCK (3-6 November 2008)

1.1.        Republic of Korea: National Human Rights Commission (NHRCK)

The Sub-Committee reviewed this application in the absence of the Korean representative on the Sub-Committee.

Recommendation: The Sub-Committee recommends that the NHRCK be re-accredited with status A.

The Sub-Committee notes the following:
1) The NHRCK is considered a "central government institution"under the National Fiscal Act and as such does not enjoy complete functional autonomy from the Government. This is in contrast to "independent institutions", which are constitutionally entrenched;
2) Under article 5 of the founding Act, the process of appointing Commissioners, on nomination from the President, the National Assembly or the Chief Justice of the Supreme Court, does not provide for formal public consultation in the recruitment and scrutiny of candidates nor forthe participation of civil society. Dear President Lee,

We, the Asian NGOs Network for National Human Rights Institutions (hereafter ANNI) are writing to you today with our deep concern regarding the current crisis within the National Human Rights Commission of Korea (NHRCK). The ANNI, which was established tomonitor the performance of National Human Rights Institutions (NHRIs) in Asia to ensure their independence and effectiveness, remains gravely concerned about the fact that the NHRCK has lost its credibility and legitimacy within the human rights community in South Korea due to its failure to perform its role as an independent watchdog to address the worsening human rights situation under your administration.

We deeply regret the fact that we have written to you several times in the past regarding the issue of the independence of the NHRCK and that to date, we have not received a positive reply from your office. Our first letter was sent in February 2008 about your government¡¯s attempt to put the NHRCK under the direct control of youroffice. The second one was regarding the outcome of the special fact-finding mission conducted over the human rights violations related to the candle-light demonstration on the issue of imported American beef in 2008, and the third one was about the arbitrary imposition of staff reduction of the NHRCK by 21% without reasonable ground in 2009.

We have been monitoring the situation inside the NHRCK closely after Mr. Byung-chul Hyun was appointed in July 2009 as the new Chairperson replacing Prof. Kyung-whan Ahn who resigned in protest against the organizational downsizing. We were alarmed by the recent news about a series of resignations of 3 Commissioners –2 Standing Commissioners and 1 Non-standing Commissioner – along with key staff and several advisers and experts who made important contributions that made the NHRCK a role model for many new NHRIs before the recent crisis.

We are particularly concerned about the common reasons for their resignations pointed out by them which are on the role of the NHRCK as an independent institutionas well as the anti-democratic decision-making process and management of the Secretariat. We were also informed that person with no known record of expertise and commitment to human rights in South Korea was appointed into the Commission to replace members and staffs who have left.  

These events have led us to believe that your government has failed to implement or has no intention to implement the recommendations made by the International Coordinating Committee¡¯s Sub-Committee on Accreditation  (ICC-SCA) on November 2008 which emphasize the importance of i) the principle of autonomy as an independent institution, ii) public, broad advertisement, consultation and scrutiny of candidates in recruitment and appointmentof commissioners with participation of civil society, iii) timely and public announcement of decisions on urgent human rights violations, iv) autonomy in appointing staff of the Secretariat.

The SCA also expressed its concerns at that time about your government¡¯s possible "interventions in the Commission¡¯s financial and administrative affairs" which turned out to be the case later in 2009.

Judging from what have recently happened, it is also becoming clear that both your government and the current leadership of the NHRCK has neither capacity nor intention to improve theperformance of the NHRCK up to international standards. This is really regretful and disappointing as the NHRCK was once regarded as one of the best models in the region and considered to be a perfect candidate for the Chairmanship of the ICC.  

We once again appeal to you to listen to the critical voices of the international human rights community as well as civil society and take the necessary measures to address this situation, including the full implementation of the recommendations of the ICC-SCA.

The ANNI remains firm in its commitment to working together with human rights defenders in South Korea to make the NHRCK independent, accountable and effective.

Annex: Recommendations from the ICC Sub-Committee on Accreditation during the Accreditation-Review of the NHRCK (3-6 November 2008)

1.1.        Republic of Korea: National Human Rights Commission (NHRCK)

The Sub-Committee reviewed this application in the absence of the Korean representative on the Sub-Committee.

Recommendation: The Sub-Committee recommends that the NHRCK be re-accredited with status A.

The Sub-Committee notes the following:

1)        The NHRCK is considered a "central government institution" under the National Fiscal Act and as such does not enjoy complete functional autonomy from the Government. This is in contrast to "independent institutions", which are constitutionally entrenched;
