2. 오는 10월 13일부터 1박 2일 일정으로 ‘의사표현의 자유에 관한 유엔특별보고관’(UN Special Rapporteur on the Promotion and Protection of the Rights to Freedom of Opinion and Expression)Mr. Frank La Rue LEWY와 동아시아지역의 인권활동가 및 언론인 등이 그동안 국제인권공동체에서 한국의 인권상황을 알려왔던 국제인권네트워크와 국제인권단체 포럼아시아(FORUM-ASIA) 등 국내외 인권시민사회단체의 초청으로 한국을 방문할 예정입니다.
3. 이들은 10월 13일(화) <의사표현의 자유에 관한 유엔 특별보고관 초청 국제심포지엄> ‘사이버상의 의사표현의 자유: 동아시아지역의 실태와 도전’과 10월 14일(수) <국제워크숍> ‘한국 표현의 자유 현황 및 유엔특별절차의 활용’에 참가하여, 한국을 포함해 동아시아 국가들이 언론의 자유를 침해하고 개인과 단체들의 의사표현의 자유를 심각하게 위축시키고 있는 실태를 알리고, 표현의 자유 보장을 위한 공동의 과제와 협력방안을 논의하기 위해 한국을 처음으로 방문한 것입니다.
4. ‘국가인권위 제자리찾기 공동행동’과 ‘인권단체연석회의’는 한국의 표현의 자유가 위축되고 있음을 크게 우려하고 있고, 이에 대한 국가인권위의 안이한 대응에도 심각한 문제가 있음을 지적하는 내용을 담아 방한에 앞서 ‘의사표현의 자유에 관한 유엔특별보고관’이 한국의 표현의 자유 동향을 이해하는데 도움이 되길 바라며 지난 10월 6일 공동서한을 보냈습니다.
5. 특히, 공동서한은 이명박 정부 출범이후 광우병 위험 미국 쇠고기 수입 등 정부정책에 반대하는 대규모의 촛불시위가 발생하였고, 이로 인해 단지 시위에 참여했다는 이유로 천여명의 시민이 기소되는 것은 물론 무자비한 경찰폭력으로 이를 진압하는 등 표현의 자유가 심각하게 훼손되고 시민의 안전을 위협받고 있는 한국의 표현의 자유에 대한 상황을 전달하고 있습니다.
6. 이 과정에서 경찰 등 정부기관의 인권침해에 대해 감시해야 하는 국가인권기구인 국가인권위에 대해 오히려 정부는 국가인권위의 의견표명에 공공연히 노골적인 불만을 표하고, 인력을 21%나 축소하는 등 국가인권위의 독립성을 크게 흔든 것은 물론 인권수호기구로서 제 역할과 기능을 하여야 하는 국가인권위마저 표현의 자유에 역행케 하는 형편에 이르렀습니다.
7. 국가인권위의 전 위원장이자 ICC의 부위원장이었던 안경환 교수가 이에 항의하여 사퇴한 후, 이명박 대통령이 임명한 현 위원장은 인권경력이 전무한 인물로서 각계의 비난과 항의 속에서 취임했습니다. 심지어 현 위원장은 취임 이후 한국의 유력 일간지와의 인터뷰에서 ‘국가보안법 폐지에 반대한다’고 밝혔습니다. 그동안 국가보안법은 ‘의사표현의 자유에 관한 유엔특별보고관’을 비롯한 국제인권공동체가 수차례 폐지를 권고한 표현의 자유를 심각하게 침해하는 대표적인 악법입니다. 한국의 국가인권위 또한 2004년에 국가보안법 폐지를 권고했습니다. 그런데 현 인권위원장이 이에 역행하는 발언을 한 것입니다.
8. 뿐만 아니라 현 위원장이 내정하고 있는 국가인권위 사무총장은 전직 판사로서 재직 시절 한 청년단체 회원 7명에게 국가보안법을 적용해 유죄판결을 한 전력이 있는 인물입니다. 지금까지 언급한 사례는 몇 가지에 불과합니다. ‘의사표현의 자유에 관한 유엔특별보고관’의 이번 한국 방문과 활동을 통해 표현의 자유의 가치와 중요성이 환기되고 표현의 자유가 후퇴하고 있는 한국 인권상황이 개선되는 계기가 될 수 있기를 바랍니다. 이 공동서한의 내용을 참고하셔서, 향후 특별보고관의 한국 방문에 많은 관심과 취재를 부탁드립니다.

"이명박 정부출범 이후 한국의 표현의 자유가 심각하게 침해되고 있고, 국가인권위마저 그 독립성이 흔들려 역행하고 있다"
한국에서 인사를 전합니다. 귀하가 조만간 한국을 방문하는 것으로 알고 있습니다. 한국 방문을 환영하며, 귀하의 이번 방문이 한국의 표현의 자유 증진의 기회가 되기를 바랍니다. 한국 인권단체들의 네트워크에 속한 우리는 최근 한국의 표현의 자유가 위축되고 있음을 크게 우려하고 있고, 이에 대한 국가인권위의 안이한 대응에도 심각한 우려를 표명하려 합니다. 이 정보가 귀하가 한국의 표현의 자유 동향을 이해하는데 도움이 되길 바랍니다.
• 2008년 한국에서는 광우병 위험 미국 쇠고기 수입 등 현 정부의 정책들에 반대하는 대규모의 촛불 시위가 두달여 계속됐습니다. 이 시위과정에서 경찰폭력의 심각성이 부각됐고 천 여명의 시민이 표현의 자유를 행사했다는 이유로 기소됐습니다. 촛불 시위를 계기로 경찰의 시위 대응은 점점 과격해지고 있고, 집회시위에 대한 권리를 행사하는 시민들은 안전을 위협받고 있습니다.
• 촛불시위를 계기로 한국의 국가인권위의 독립성 또한 흔들리게 되었습니다. 국가인권위원회는 촛불시위 진압과정에서의 경찰폭력을 지적하고 비판하는 의견을 발표했습니다. 정부기관의 인권침해에 대해 감시해야 하는 국가인권기구로서 당연히 해야 할 일이었습니다.
그러나 당국은 국가인권위의 의견표명에 노골적인 불만을 표했고, 국가인권위의 인력을 21%나 축소했습니다. 국가인권위의 전 위원장이자 ICC의 부위원장이었던 안경환 교수가 이에 항의하여 사퇴했습니다. 이후 대통령이 임명한 현 위원장은 인권경력이 전무한 인물로서 각계의 비난과 항의 속에서 취임했습니다. 현 위원장은 취임 이후 한국의 유력 일간지와의 인터뷰에서 ‘국가보안법 폐지에 반대한다’고 밝혔습니다. 아시다시피 국가보안법은 유엔 ‘표현의 자유 특별보고관’을 비롯해 국제인권사회가 수차례 폐지를 권고한 표현의 자유 침해 악법입니다. 한국의 국가인권위 또한 2004년에 국가보안법 폐지를 권고했습니다. 그런데 현 인권위원장이 이에 역행하는 발언을 한 것입니다. 뿐만 아니라 현 위원장이 내정하고 있는 국가인권위 사무총장은 전직 판사로서 재직 시절 한 청년단체 회원 7명에게 국가보안법을 적용해 유죄판결을 한 전력이 있는 인물입니다.
한국의 국가인권위원회는 2001년 설립되었고, 표현의 자유를 포함하여 인권의 보호와 증진을 위해 노력해왔습니다. 그런데 언급한 바와 같이 현 정권이 들어선 2008년 이래 국가인권위의 독립성은 크게 흔들리게 되었고 국가인권위마저 표현의 자유에 역행하는 지경에 이르렀습니다.
• 유감스럽게도 국가보안법 적용사례는 최근 늘어가고 있습니다. 이전 정권에서 국가보안법이 폐지되지는 못했지만 거의 적용되지 않았던 것과 달리 2009년 6월 25일 현재 국가보안법 위반사범 검거는 30명으로 지난해 같은 기간에 비해 약 2배가 늘었습니다. 인터넷에 올린 글을 국가보안법 상 이적표현물 게시 혐의로 구속하는 사례가 많습니다. 이런 상황에서 표현의 자유에 역행하는 국가보안법을 국가인권위원장이 옹호하는 것은 모순이 아닐 수 없습니다.
• 인터넷 기고자, 특히 블로거들에 대한 검열과 금지가 늘어나고 있습니다. ‘미네르바’ 라는 필명의 유명 인터넷 기고자가 당국의 경제정책을 비판했다는 이유로 구속됐다 풀려났습니다. 미네르바의 구속수사로 인해 인터넷 기고자들은 외국 사이트로 사이버 망명을 하거나 글쓰기를 중단하는 일이 대규모로 벌어졌습니다. 당국에서 사이버모욕죄 등을 도입하려 하기 때문에 이런 추세는 악화될 것으로 보입니다.
• 시민에 대한 정보기관의 사찰이 이뤄지고 있습니다. 최근 군 정보기관(국군기무사)이 시민에 대한 사찰활동을 벌인 것이 드러나 문제가 됐고, 국가정보원 역시 불법적인 민간사찰을 한 것으로 주목받고 있습니다. 그러나 정보기관의 사찰의혹에 대해 폭로하고 항의한 한 시민운동가가 오히려 당국에 의해 국가 명예훼손 혐의로 고소 됐습니다.
• 이처럼 표현의 자유 행사에 대한 당국의 보복이 대규모로 이뤄지고 있습니다. 2009년에는 정부의 독선적인 정국운영과 민주주의의 위기를 염려하는 내용의 시국선언이 이어졌습니다. 특히 교사노동조합이 2009년 6월 18일 시국선언을 했습니다. 1만 6천여명의 교사가 이 선언에 참여했는데 교육부는 88명의 교사에 대해 해임 등 중징계를 했고, 96명의 교사를 형사고발했습니다.
• 언론인에 대한 해임과 구속이 이어지고 있습니다. 정부의 정책을 비판한 시사프로그램의 제작자들에 대한 해임과 징계, 검찰 수사가 계속되고 있습니다. 한 예로 미국 소고기의 광우병 위험성을 보도한 MBC의 PD수첩에 대한 수사과정에서는 수사당국이 작가의 개인 이메일을 공개하기도 했습니다. 정부는 시사프로그램을 통폐합하려는 압박을 가하고 있고, 미디어법을 개정해 언론재벌의 방송참여를 확대하려 했습니다. 언론인들은 이에 저항하고 있고 이 과정에서 언론인에 대한 고소고발과 해임과 징계라는 보복이 늘어난 것입니다.
• 표현의 자유 후퇴는 집회시위에 대한 금지에서도 여실히 드러납니다. 경찰청 통계에 따르면 2008년 1년동안 집회금지통고건수는 149건입니다. 그런데 2009년 4월까지 금지통고 건수는 164건으로 작년 한해동안 보다 더 많은 집회금지가 불과 4개월동안 있었습니다. 또한 집회에 참여한 시민들에 대한 경찰폭력이 문제되고 있습니다. 일부 시민단체들은 집회시위 조직과 참여를 이유로 비영리민간단체 공익활동 지원사업에서 탈락했습니다. 한 예로 당국은 광우병 소고기 대책위원회에 소속된 1800여개 시민단체를 ‘불법폭력시위 관련단체’로 지목하고 2009년 사업지원대상에서 제외했습니다.
• 하지만 이런 현실에도 불구하고 국가기관에 대한 국가인권위의 권고 수용율은 계속 떨어지고 있습니다. 앞에 언급한 표현의 자유 침해 사례에 대해 국가인권위가 소극적일뿐더러 권고를 한들 관계 당국이 수용하지 않는 상황입니다. 국가인권위 출범 이후 진정사건의 80% 이상이 국가 공권력에 의한 인권침해였습니다. 우리는 최근에 그런 사례가 더 늘어나고 있음에도 불구하고 국가인권위의 대응이 오히려 후퇴하고 있는 것에 크게 우려합니다.
지금까지 언급한 사례는 몇가지에 불과합니다. 그렇지만 표현의 자유 후퇴에 대한 우리의 우려를 전달하기에는 충분하다고 생각합니다. 두말할 필요 없이 표현의 자유는 인권 보장의 기초 중의 기초입니다. 귀하의 이번 한국 방문에서 표현의 자유의 중요성과 가치에 대한 깊은 토론과 표현의 자유를 억압하는 당국에 대한 지적이 있기를 바랍니다. 감사합니다.

Dear Mr. Frank La Rue:
The Coalition of Human Rights NGOs sincerely welcomes to you on your upcoming visit to the Republic of Korea and hopes this event to be an opportunity to promote and protect freedom of expression in Korea. We expresses genuine concern that this freedom is being grossly undermined but the National Human Rights Commission(hereinafter: 'NHRC') is not taking appropriate measures in response to this situation. In the following we seeks to provide you within formation so that you maybe better equipped to understand the current situation in Korea.
1. In 2008, there was a series of candlelight vigils over the course of two months protesting the government’s policies, including US beef imports over fears of the mad cow disease. These protests provide a window into the serious nature of police violence in Korea and thousands of citizens are being prosecuted for rightfully exercising their freedom of expression. The candlelight vigils provided an incentive for wide-spread use of excessive police force, threatening the safety of citizens practicing their right to assembly.
2. The candlelight vigils have also served to undermine the independence of the NHRC. The NHRC has the power to monitor the government for human rights violations and expressed its criticism of the use of excessive force during the policing of candlelight vigils.
However, the government explicitly stated its dissatisfaction with the opinion expressed by the NHRC and reduced its workforce by 21%. Professor Kyung-Hwan Ahn, former chairperson of the NHRC and vice-chairperson of the ICC, protested this measure and has since resigned. The current chairperson Byung-Chul Hyun was appointed by the president and took office amidst wide-spread disapproval of his lack of professional knowledge and experience in human rights.
The chairperson has since expressed opposition to abolition of the National Security Law in an interview with an influential Korean newspaper. As you may be aware, the international human rights society, including the UN Special Rapporteur on freedom of expression, condemns the National Security Law and issued numerous recommendations for its abolition. The NHRC recommended its abolition in 2004. Needless to say, his statement is in direct contradiction to these recommendations. Furthermore, the secretary-general of NHRC, who was appointed by the chairperson, has in the past convicted seven members of a youth group for violations of the National Security Law while he was a judge.
The NHRC was established in 2001 and has since endeavored to promote and protect human rights in Korea. However, since the Lee Myung-bak administration took office in 2008, the integrity of NHRC has been undermined and the commission is failing its role as a human rights advocate.
3. Unfortunately, the instances of prosecutions under the National Security Law have been increasing. Although the former Roh Moo-hyun administration failed to abolish this act, act itself was almost never executed under the former administration. In stark contrast, the current number of prosecutions for violations of this act has almost doubled in a comparable period to last year, resulting in some thirty cases. Many cases involve charges brought against writings posted online for expressing praise or incitement contrary to interests of the state. It can only be described as ironic that the chairperson of the NHRC is an advocate of this act.
4. Cases of censorship and prohibition of online writings, of bloggers in particular, have been increasing. A well-known online writer under the pseudonym "Minerva" was arrested for expressing disapproval of the government's economic policies and was released. Online writers have since moved their operations to overseas websites or have otherwise ceased writing altogether. This trend is expected get worse as the national government intends to propose a bill that punishes cyber defamation.
5. Intelligence agencies have been conducting investigations on private citizens. The recent uncovering of investigations conducted by the military intelligence agency on private citizens brews much controversy; the National Intelligence Service is also suspected of conducting illegal investigations. Unfortunately, a influential activist who brought these allegations against the National Intelligence Service is being prosecuted on charges of state defamation.
6. Thus continues the retaliatory measures of the government against freedom of expression. In 2009, a series of public proclamations expressed deep concern for the autocratic governance shown by the administration and its weakening effect on Korean democracy. In one particular case, the Korean Teachers and Educational Worker's Union issued a public statement on June 18, 2009. Of the 16,000 teachers that participated in the event, the Ministry of Education issued severe disciplinary measures, including removal from office, against 88 teachers, and brought criminal charges against 96 teachers.
7. Members of the media are currently in danger of removal and detention. Producers of current events programmes that criticized government policies have been removed, reprimanded or are being investigated by the public prosecutor. A television programme "Producer's Notebook" on channel MBC reported on the dangers of mad cow disease in relation to US beef and the producer of this programme was subsequently investigated by the public prosecutor, whereby the producer's e-mails were released for public viewing. The government is putting pressure to merge and abolish these current events programmes while amending media laws to allow press tycoons to expand their reach into broadcasting. The governmental actions against the members of the media have largely been an effort to counter their resistance.
8. The regress of freedom of expression is also apparent in the prohibition of protest assemblies. According to National Policy Agency statistics in 2008, there were 149 cases of assembly prohibition notice issuances in one year. 164 such cases have been reported until April of this year, in just four months, a number higher than total of last year. Use of excessive police force against citizens in an assembly has also been an important issue. Several civic organizations have been denied funding granted to non-profit, non-governmental, public interest organizations for having participated in the assemblies. Approximately 1800 civic organizations that belong to the strategic committee on beef infected with mad cow disease have been excluded from funding this year after being fingered as 'organizations employing illegal use of force in assemblies'.
9. In spite of this state of affairs, the government has been progressively ignoring the recommendations issued by the NHRC. Not only has the NHRC shown passive attitudes towards aforementioned violations of freedom of expression, but also the recommendations of the NHRC are more frequently ignored by the government. For your information, since NHRC’s establishment, 80 per cent of petition cases were human rights violations by the government. The Coalition has serious concern that the NHRCs are unresponsive to the increasing number of these cases.
Only a few cases have been so far enlisted; these cases are representative of the full spectrum of Coalition's concerns for freedom of expression. It is self-evident that freedom of expression is a fundamental human right. The Coalition welcomes this opportunity for you not only to participate in the discussions on the value and importance of freedom of expression but also to condemn the suppressive measures undertaken by the Korean government. We deeply appreciate your interest in this matter.
