Dear Ms. Lynch,
We are writing to you today with our deep concern regarding the current developments within the National Human Rights Commission of Korea (NHRCK). We feel that there is strong reason to believe that the most recent statements made by the NHRCK’s new Chairman, Mr. Hyun Byung-chul, has put the independence of the NHRCK in doubt. Hence, we believe that there is a need for the ICC to conduct a special review on the status of the NHRCK and dispatch a fact-finding mission to Seoul at the soonest possible time.
On 18 September, Mr. Hyun Byung-chul attended a hearing at the National Assembly and testified regarding two ongoing issues within the NHRCK. First, lawmaker Mr. Jang Jae-won asked Mr. Hyun about his view of the government making a significant reduction of 21.2% of the staffs at the NHRCK last April. He expressed his agreement of the government’s actions citing that they had legitimate reasons for the downsizing of NHRCK. Second, lawmaker Mr. Shin JI-Ho questioned Mr. Hyun on his definition of the status of the NHRCK as whether it should be an independent commission, separate from the executive, legislative, and judicial branches of the government, or whether it should remain autonomous, yet belong under the executive branch of government. Mr. Hyun responded that “legally the latter view is the case, but I have yet to think more about it.”
These two statements made by Mr. Hyun are indeed alarming because they go against the previous stand of the NHRCK when it asserted its independence in the face of threats coming from the government. The international community stood by the NHRCK during those challenging times, including the UN Office of the High Commissioner for Human Rights (OHCHR) and the ICC itself. On 16 January 2008, when the Presidential Transition Committee made the recommendation to place the NHRCK under the direct control of the Office of the President, the UN High Commissioner on Human Rights herself, Ms. Louise Arbour, transmitted a letter to the government of the Republic of Korea expressing her concern over this recommendation and pointed out that this would compromise the position of the NHRCK as an “internationally highly regarded national human rights institution” and a “model for other countries.” Furthermore, last March, your office had written to the Minister of Foreign Affairs and Trade of the Republic of Korea, urging them to reconsider their decision to significantly reduce the staff of the NHRCK given the impact it may have on the NHRCK’s independence and therefore the status within the ICC.
We note that under Article 16.2 of the revised ICC Statute, the Chairperson of the ICC or of any member of the Sub-Committee on Accreditation may initiate a review of the NHRCK’s status if it appears that its circumstances have changed in a way which affects its compliance with the Paris Principles.
We therefore urge the ICC to immediately dispatch a fact-finding mission to Seoul to look into these developments happening within the NHRCK and undertake a special review to ascertain whether the NHRCK still deserves to be a status A institution under the ICC.

저희 아시아 국가인권기구 감시 네트워크 (ANNI: Asian NGOs Network on National Human Rights Institutions)는 현재 한국의 국가인권위원회 내에서 벌어지고 있는 일련의 사태를 심각하게 우려하며 오늘 서신을 보내드립니다. 저희는 국가인권위 현병철 신임위원장의 가장 최근의 발언이 국가인권위의 독립성을 불확실하게 만들었다고 볼 강한 이유가 있다고 믿습니다. 따라서 저희는 국가인권기구 국제조정위원회가 국가인권위의 위상에 대해 특별 심사를 실시하며 가급적 조속히 서울에 진상 조사단을 파견할 필요가 있다고 봅니다.
9월 18일에 현병철 위원장은 한국 국회의 청문회에 참석해서 국가인권위 내 현안 두 가지에 대해 증언했습니다. 첫째, 장제원 의원이 지난 4월 한국 정부가 국가인권위 조직과 인력을 무려 21.1%나 축소한 데 대해 현병철 위원장의 의견을 물었습니다. 그러자 현병철 위원장은 정부 조치에 동의한다고 말하며, 정부가 국가인권위를 축소할 정당한 이유가 있다고 말했습니다. 둘째, 신지호 의원은 국가인권위의 위상에 대한 현병철 위원장의 정의—즉 국가인권위가 정부의 행정, 입법, 사법부와는 별개인 독립적인 위원회이어야 하는지, 또는 자율성은 유지하되 행정부 아래에 있어야 하는지—에 대해 질문했습니다. 그러자 현병철 위원장님은 “법적으로는 후자가 맞으나 본인은 이에 대해 생각을 더 해봐야겠다”라고 답변했습니다.
현병철 위원장의 이 같은 발언 두 가지는 진정으로 놀라우며 불안을 야기하는데, 이는 이들 발언이 한국 정부에서 비롯되는 위협에 맞서 스스로의 독립성을 역설한 국가인권위의 종전의 입장에 배치되기 때문입니다. 이 같은 시련의 시기 동안 유엔 고등 인권 판무관실과 국가인권기구 국제조정위원회 자체를 포함하는 국제 사회는 한국의 국가인권위를 지지하고 도왔습니다. 2008년 1월 16일에 한국의 대통령직 인수 위원회가 국가인권위의 청와대 직속 기구화를 건의하자 다름 아닌 유엔 고등 인권 판무관인 루이즈 아버(Louise Arbour)는 한국 정부에 서신을 전달해 이 건의에 대한 우려를 표명하고 이 같은 조치가 “국제적으로 높이 평가되는 국가인권기구”이자 “기타 국가들에 대한 모범”으로서의 국가인권위의 위상을 훼손하리라고 지적하기에 이르렀습니다. 게다가 지난 3월에 위원장님의 사무소는 한국의 외교통상부 장관에게 국가 인권위의 조직과 인력을 상당 부분 축소하겠다는 정부 결정을 재고하도록 촉구했는데, 이는 이 같은 조치가 국가인권위의 독립성 및 국가인권기구 국제조정위원회 내에서의 위상에 가할 수 있는 타격 때문이었습니다.
저희가 살펴본 바 개정된 국가인권기구 국제조정위원회법(ICC Statute) 16.2조에 의하면, 한국 국가인권위의 ‘국가인권기구의 지위에 관한 원칙’(‘파리원칙’) 준수에 영향을 미치는 방식으로 주변 상황이 변화한 것으로 보이는 경우에는 국가인권기구 국제조정위원장 또는 인증 소위원회(Sub-Committee on Accreditation)의 어떠한 회원도 국가인권위의 위상에 대한 심사를 시행할 수 있습니다.
따라서 저희는 국가인권기구 국제조정위원회가 즉각 서울에 진상 조사단을 파견해 한국의 국가인권위 내에서 벌어지고 있는 일련의 사태를 조사하며, 국가인권위가 계속해서 국가인권기구 국제조정위원회 휘하 A급 기구로 평가되고 남아야 하는지 특별 심사를 실시하도록 촉구합니다.
